SC orders Palace to pay back rentals to 90-year-old woman

MANILA, Philippines — Tarcila Mendoza’s battle to reclaim her two-story wooden house and lot at 1440 Arlegui Street near Malacañang that was seized by the guards of then President Ferdinand Marcos 32 years ago has finally ended.

In a decision issued on Oct. 4, the Supreme Court ruled that the property that was used as an office by Malacañang and became home to Presidents Corazon Aquino and Fidel V. Ramos after the ouster of Marcos in 1986 should be returned to Mendoza.

It was the same house where, according to the late columnist Louie Beltran, Aquino hid under her bed while a coup was in progress in 1987 — an accusation she denied and for which the newsman was slapped a libel suit, later dismissed by the Court of Appeals.
The high court ruled that the Office of the President should pay rent of P20,000 per month since July 1975, plus 6-percent interest and attorney’s fees, to Mendoza, the declared owner of the 4,924.6-square-meter property.

Justice delayed

The tribunal directed Malacañang “to pay its obligation with reasonable dispatch” so that “simple justice, while perhaps delayed, will have its day.”

“Private respondent is in the twilight of her life, being now over 90 years of age. Any delay in the implementation of this disposition would be a bitter cut,” the tribunal said.

It said the Arlegui property was seized by the Marcos martial law regime and a new certificate of title conjured without the owner legally canceling the original title.

The Palace will comment after reading the Supreme Court’s decision, Press Secretary Ignacio Bunye said Monday night.

Mind-boggling

In its ruling, the high tribunal nullified the decision of Manila Regional Trial Court Judge Vicente Hidalgo to award Mendoza P1.48 billion in rent and P143.6 million in just compensation, saying the amount was “mind-boggling” and excessive.

The Supreme Court pointed out that the assessed value of the Arlegui property was P2.38 million.

It dismissed the solicitor general’s contention that the Manila court had erred when it tried Mendoza’s case without giving the government the opportunity to present its defense.

The high tribunal said the Office of the Solicitor General had been declared in default for its failure to participate during the trial.

“The petitioner may have indeed been deprived of such hearing, but this does not mean that its right to due process had been violated,” it said. “The handling solicitors simply squandered the republic’s opportunity to be heard.”

House vacated out of fear

Mendoza filed a suit with the Manila RTC in 1999 to nullify the supposed deed of sale for her property in July 1975, which led to the issuance of a new transfer certificate of title (TCT) showing that it now belonged to the government.

She had said that in July 1975, armed men, who identified themselves as belonging to the Presidential Security Group, forcibly entered her house and ordered her to hand over the original TCT for the property.

Out of fear, she added, she followed the order and vacated the property. With a report from Christine O. Avendaño
